Recent Pennsylvania DUI Law Changes

      New offense: DUI within 10 years of completing ARD (Act 58 of 2025, HB 1615)

      After the state Supreme Court ruled in Commonwealth v. Shifflett (2025) that past ARD can’t be treated as a prior offense, Act 58 created a separate misdemeanor, DUI following diversion (75 Pa.C.S. §3802(h)), for a DUI within 10 years of finishing ARD, punishable by up to 6 months and a fine. It also amended §3806 on what counts as a prior offense.
