Recent Nevada DUI Law Changes

    1. October 1, 2025

      Lower BAC trigger for evaluation, longer minimum jail for a second DUI

      Senate Bill 309 (Statutes of Nevada 2025, chapter 502) lowers the BAC that triggers a mandatory alcohol or substance use disorder evaluation from 0.18 to 0.16, raises the minimum jail or residential confinement for a second DUI within 7 years from 10 to 20 days, and tightens who may apply for a treatment program instead of the usual sentence.

    2. 2023 (approved May 31, 2023)

      No more distinctive garb for DUI community service

      Assembly Bill 17 (Statutes of Nevada 2023, chapter 141) removed the rule that a person convicted of DUI must wear distinctive garb identifying them as a DUI offender while doing court-ordered community service.
